1. Organising Company and presentation of the Game
1.1 Eurosport, a Société par Actions Simplifiée, registered in the Nanterre Trade and Companies Register under number B 353 735 657, whose registered office is at 3, Rue Gaston et René Caudron - 92798 Issy les Moulineaux Cedex 9 - France (the "Organising Company"), has decided to organise from 23 August (00:00 GMT+2) to 6 September 2023 (23:59 GMT+2) included a game entitled “Eurosport x Etxeondo”, participation in which is entirely free of charge (the "Game").
1.2. The Game is organised in partnership with ESTAMPACIONES ARTESANAS, S.A., registered with the Registro Mercantil de Gipuzkoa, Hoja SS-2.137, having its corporate offices at Polígono Laskibar, local 1-1ª, 20271, Irura (Gipuzkoa) and N.I.F. A-20087813 (the “Partner”).
1.3. The Game takes place on Instagram and is accessible though @eurosportes (Eurosport Spain) or @eurosportnl (Eurosport Netherlands), depending on the country of residence of the Participant (the "Platform").
2. Participation and acceptance of the Rules
2.1. Participation in the Game implies that each participant (hereinafter, the "Participant(s)") has read and accepted, without reservation, these rules (the "Rules"), which apply to all Participants, and the principle of the Game. Any Participant who contravenes one or more of the articles of these Rules will be deprived of the opportunity to take part in the Game, as well as of any Prize that he or she may have won.
2.2. The Game is open to all natural persons over the age of eighteen (18), residing in Spain (excluding the islands of Canarias and Baleares and the cities of Ceuta and Melilla) or the Netherlands.
2.3 Under no circumstances may persons who have collaborated in the organisation of this Game or who have a direct or indirect legal link with the Organising Company and/or the Partner take part in this Game.
2.4. Any form of participation in the Game other than that expressly defined in these Rules is excluded and may not be taken into consideration by the Organising Company.
2.5. Participation in the Game is limited to one entry per person (same e-mail address associated with the Instagram account).
3. Access to the Rules
3.1 Each Participant may consult the Rules free of charge:

4. Game mechanism and rules
4.1. To take part in the Contest and have a chance of winning the Prize, each Participant must:
Follow the applicable Eurosport Instagram account (@eurosportes o @eurosportnl), depending on the country of residence of the Participant;
Follow the Exteondo Instagram account (pertaining to the Partner) to which the Game Post on the Eurosport Instagram page will redirect;
Comment the applicable Eurosport Instagram post relating to the Game;
Accept these Rules without reservation;

5. Determining the Winner(s)
5.1. A random draw (the "Draw") will be made by the Organising Company at the end of the Contest from among all the Participants who have entered in accordance with the terms of these Rules.
5.2. The Participants will be divided into two groups (one per country), and the Organiser will designate one (1) Winner per group.
5.3. The random draw will take place on 27th May 2024.
5.4. At the end of this random draw, two (2) winners (1 per country) (the "Winners") and two (2) runners-up (the “Runners-up”) per country will be designated.
5.5. The Winners shall be informed of his/her victory by the Organising Company within a maximum of 2 (two) days following the Draw. The Organising Company will contact the Winner via private message at the Instagram account used for participating. No message will be sent to the other participants that have not won.
5.6. In the event that the Winner does not confirm his/her acceptation of the prize within seven (3) days of being contacted by the Organising Company, or if the Winner declines his/her prize, or if the Winner has not fulfilled the conditions of Participation or has not complied with these Rules, the Organising Company shall proceed to name as Winner the first runner-up according to the order established in the Draw, proceeding in the same terms as in the case of the first chosen Winner, and so on, until the actual delivery of the Prize.
5.7. The Prize will be declared void if it is not possible, in the last instance, to award the prize any of the Runners-up.
6. Prize(s) and terms of award
6.1. The Winner will receive the following prize: a t-shirt and cycling shorts, of a value of 368 euros (three hundred and sixty-eight euros), provided by the Organising Company (the "Prize").
6.2. The Organising Company reserves the right to replace the Prize with a prize of equivalent value, without the Participants and the Winner being able to make any claim in this respect.
6.3. The Participants are entirely responsible for the validity of their contact details given at the time of their Entry and the Participants acknowledge that the Organising Company may not be held responsible for the non-delivery of e-mails and/or the Prize due to incomplete, imprecise or incorrect contact details.
6.4. The Winner undertakes to provide a copy of his/her identity document to the Organising Company in order to confirm his/her identity. Without this, the Organising Company will not be able to award the Prize.
6.5. Everything that is not expressly included in the Prize as referred to above is deemed to be excluded (by way of example: personal expenses or any other expense that the Winner may incur in connection with his/her participation in the Game).
6.6. The Prize may not be exchanged or taken back, nor may it be the subject of any financial consideration or financial equivalent. Any complaints regarding the provision of the Prize may not consist of financial consideration and/or a financial equivalent. The Prize is personal and non-transferable and under no circumstances may a person other than the Winner be designated as the winner or beneficiary.
6.7. It is specified that the Organising Company will not provide any guarantee, assistance, enjoyment or provision service, as the Prize consists solely of the provision/implementation of the Prize as described in these Rules.
6.8. Under no circumstances may the Organising Company or the Partner be held responsible for the delay in making the Prize available or in the event that the Winner is unable to benefit from the Prize due to circumstances beyond the control of the Organising Company and/or the Partner.
7. Taxation of the Prize for Spain Winner
7.1. In accordance with current tax regulations, Participants in this Game are informed that prizes awarded for participation in games, competitions, raffles, or random combinations linked to the sale or promotion of goods or services are subject to withholding and payment on account of Personal Income Tax provided that the value of the prize is greater than 300 €.
7.2. A 19 percent withholding will be applied to the taxable base, and this will be determined by increasing the acquisition value or cost to the payer of the good delivered by 20 percent.
7.3. The Winner for Spain must confirm their personal details on the day the Prize is awarded, as well as show their ID card or Resident Card if required. In order that the withholdings mentioned in the previous point can be made, the said winner must in any case sign a written proof of receipt of the prize on receipt of the same and provide a photocopy of his/her ID card. Otherwise, he/she will lose his/her right to receive the Prize.
7.4. The completion of the Winner's personal and fiscal data, necessary for the delivery of the prizes, is obligatory, so that the absence of any of said data will mean the loss of the right to the prize obtained.
7.5. Acceptance of the prize by the Winner entitles the Organising Company to make the aforementioned withholding or payment on behalf of the winner and will inform the competent tax authorities of the amount of the prize, the ID number and the name of the person receiving the Prize.
8. Authorisations
8.1. The Winner expressly accepts, free of charge, that his/her surname, first names entered on the Platform may be quoted and published by the Organising Company and/or the Partner.
8.2. In this regard, the Winner grants, in advance and without financial consideration, the Organising Company and the Partner a non-exclusive licence to use, reproduce, represent and communicate his/her first names, surnames for promotional purposes for the Game or the activity of the Organising Company or the Partner, on all communication media. This option does not constitute an obligation for the Organising Company and/or the Partner.
8.3. This licence is granted worldwide, for all uses in all media and by all distribution processes known or unknown to date, and for the duration of the legal intellectual property protection (including renewals and extensions) for the maximum time permitted by law and without limitations other than those under copyright law.
8.4. The Organising Company and the Partner shall not be liable for any falsehood or inaccuracy in the statements made by the Participant, as well as for any infringement of third party rights made by the Participants in the framework of the Sweepstakes, the Participants holding the Organising Company and the Partner harmless in such cases.
9. Use of Personal Data
9.1. Participation in the Game may involve the collection and processing by the Organising Company of certain personal data of the Participants and the Winner.

10. Liability and Reserves
10.1. The Organising Company and the Partner may not be held liable for any total or partial malfunctioning of the Internet network, whether or not this results in failures in the administration, security, entry, integrity or management of the Game. In particular, they may not be held liable for any errors, omissions, imperfections, interruptions, deletions, transmission delays, communication and connection circuit failures, destruction, damage or any other problem related to telecommunications networks, computers and online terminals, servers or access providers.
10.2. The Organising Company reserves the right to exclude from participation in this Game any person who disrupts its progress. It reserves the right to take legal action against anyone who has cheated, defrauded, rigged or disrupted the operations described in these Rules or attempted to do so. Any Winner who has cheated will be automatically stripped of any right to obtain any Prize.
10.3. The Organising Company reserves the right, in particular in the event of an overriding reason, to shorten, extend or cancel the Game in part or in its entirety if circumstances so require, and the Participants acknowledge that it may not be held liable as a result.
10.4. The Organising Company reserves the right to temporarily suspend the possibility of participating in the Game if it or any of its technical service providers (and in particular its hosting service providers) are no longer able to ensure the continuity of the service necessary for the Game to run.
10.5. The Organising Company may always, in the event of force majeure, a fortuitous event or an exceptional circumstance (fire, flood, natural disaster, malicious intrusion into the computer system, strike, questioning of the financial and technical equilibrium of the Game, etc.), even if this is its own responsibility (subject in any case to its good faith), cease all or part of the Game.
10.6. The Game will be cancelled in the event of the dissolution of the Organising Company or the Partner, as well as in the event of force majeure, without Participants being entitled to claim any compensation in this respect.
10.7. The Organising Company reserves the right to modify the Rules at any time without notifying the Participants. In this case, the updated Rules shall be uploaded and published on the Platform and made accessible to the Participants.
10.8. Any information provided by the Participants, in particular their contact details, will be considered null and void and will not be taken into consideration if it contains an anomaly.
10.9. The Participants acknowledge that the Organising Company may not be held liable for any prejudice of any kind (personal, material, financial or other) arising from their participation in the Game.
10.10. The Organising Company expressly declines all liability for any incident or prejudice of any nature that may arise as a result of the Participants' participation in the Game and/or enjoyment of the Prize and/or as a result of its use by the Winner, and this is expressly acknowledged by the Participants and the Winner. The Participants and the Winner therefore waive any claim and any recourse against the Organising Company and/or the Partner and/or any of the companies in the group to which they belong (namely, for the Organising Company, the Warner Bros. Discovery Inc. group), on the aforementioned grounds, and in particular, as regards the Prize, its quality or any consequences arising from taking possession of the Prize.
11. Applicable law and settlement of disputes
11.1. These Rules are governed by Spanish or Dutch law, depending on the country of residence of the Participant.
11.2. In order to be taken into account, any disputes relating to the Game must be made no later than thirty (30) days from the end of the Game, in writing only and sent to the following address:

11.3. The Organising Company shall decide any question relating to the application of these Rules or not settled by these Rules. Apart from cases of fraud by the Participants, any dispute that may arise in connection with the execution of these Rules shall be settled as a matter of priority out of court between the Organising Company and the Participant.
11.4. Any dispute that may arise over the interpretation of these Rules shall be expressly subject to the law of the Participant’s country of residence (Spain or the Netherlands) and to the sovereign judgement of the Organising Company and, as a last resort, to the judgement of the competent Court of the Participant’s country of residence.
